These Terms and Conditions (“Terms”) govern your use of the Newsletter Mind service and website. By using the service, you agree to these Terms. If you do not agree, please do not use the service.
1. Description of the Service
Newsletter Mind allows you to generate HTML newsletter content from a URL (e.g. a webpage or blog post). The service may be used with or without creating an account. When you are signed in, we may store your generation history and preferences to improve your experience.
2. Acceptable Use
You agree to use the service only for lawful purposes. You must not:
- Submit URLs or content that infringe third-party rights (e.g. copyright, trademark) or that are illegal, harmful, or offensive.
- Attempt to reverse-engineer, overload, or disrupt the service or its infrastructure.
- Use the service to send spam or unsolicited communications in violation of applicable law.
- Resell or redistribute the service or output in a manner that violates these Terms.
We reserve the right to suspend or terminate access if we reasonably believe you have breached these Terms.
3. Account and Authentication
If you sign in (e.g. via Google), you are responsible for keeping your account secure. You must provide accurate information. We are not liable for unauthorised use of your account resulting from your failure to protect your credentials.
4. Intellectual Property and Content
You retain ownership of the URLs and prompts you submit. The HTML and copy generated by the service are provided for your use; we do not claim ownership of your generated newsletters. You are responsible for ensuring that the content you generate and send complies with applicable law and that you have the right to use any source material (e.g. website content) you feed into the service.
5. Disclaimer
The service is provided “as is”. We do not guarantee that generated content will be error-free, fit for a particular purpose, or compliant with email clients or legal requirements in your jurisdiction. You are responsible for reviewing and approving any content before use.
6. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us (if any) in the twelve months preceding the claim, or zero if the service is free.
7. Privacy
Your use of the service is also governed by our Privacy Policy and Cookie Policy.
8. Changes to the Service and Terms
We may change the service or these Terms from time to time. We will indicate the “Last updated” date for the Terms. Continued use of the service after changes constitutes acceptance of the updated Terms. For material changes, we may notify you via the website or by email where appropriate.
9. Governing Law
These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, unless otherwise required by mandatory law in your country.
